What The SCOTUS Ruling Means For Healthcare

The Supreme Court has upheld the Affordable Care Act (ACA), a frustrating situation in which conservatives won the policy battle, but lost the war over the Act.  In particular, the Court held that Congress cannot use the Commerce clause to compel commerce.  The individual mandate qua mandate is unconstitutional.  However, the Congress has the right to impose taxes (if not punitive and excessive), which permits the Obama administration to add a tax on millions of uninsured Americans in addition to the ACA’s already-massive tax burden on the middle class.

The Court ruled that a Medicaid expansion could be an unconstitutional federal coercion of the states, but this expansion does not have a penalty large enough to pass that threshold.  Interestingly, the Court opened up the possibility that governors could refuse the Medicaid expansion.  Those same individuals would then be eligible for subsidies in the exchanges.  If all the governors refused the expansion, and if individuals take up subsidized insurance the federal cost heads even farther north.

In a bit of a pyrrhic victory, the Forum’s amicus briefs, signed by over 200 economists, were cited twice in the Court’s dissenting opinion.  (See my amicus brief.)

The field of play now shifts from a legal battle to a policy debate.  In addition to the Court’s endorsement of the policy foundations of the challenge to the ACA, the fundamental policy flaws remain.

The ACA remains a damaging, anti-growth vehicle for taxation.  The so-called Medicare surtax increases marginal tax rates on the return to saving, investment, and innovation.  The medical device tax will hurt innovation and cost jobs.  A bill to repeal it is gathering dust in the Senate.  Also, the insurers fee – the “premium tax” – will roil insurance markets, disrupt patient-provider relationships, and the vast majority of the burden will fall on the middle class.

Heritage & Roberts decree, all the world be taxed

The Supreme Court’s decision upholding the ACA is deliciously ironic. The “individual mandate”–an idea promoted for everyone in the 90s and for Massachusettians (?) in the 2000s by the arm of the Republican party known as the Heritage Foundation–was found to be legal. But not as a mandate, instead as a tax.

Put aside for a minute the dreadful political contortions required to get this quasi-universal health insurance bill past Congress in the first place. Put aside the fact that the supposedly non-political Supreme Court hands down decisions time after time that are a pure reflection of the exceedingly public extreme political views of its justices. Put aside for a minute the fact that the ACA has undeniably kickstarted a round of changes in the health care delivery and insurance system that at least has the potential to lower costs and improve care, and that the luncay of politics meant we nearly lost that momentum.

Instead focus on what the Supremes have done. They’ve cut through decades of rhetoric about how we pay for health insurance and clarified it thus: we pay for health care via taxes–whether they are private taxes on employers and employees (and now individuals) or public ones on citizens.

Finally, Quality We Really Care About

Patient-centered care and patient engagement have become central to the vision of a high value health delivery system. The delivery system is evolving from a fee-for-service transactional payment model to a value-based purchasing model using outcome data and quality improvement and attainment. The Centers of Medicare and Medicaid Services (CMS) and private payers have spurred delivery redesign of networks that focuses on a set of clinical quality measures and patient care experiences along with efficiency measures.

However, the questions we ultimately really care are: “Did I get better? Am I healthier?”

With the advent of Facebook, PatientsLikeMe® and Avado, consumers and patients are sharing their healthcare experiences openly with their support system and strangers with similar illnesses. Our delivery system has yet to leverage the power of patient/consumer reported data in feeding back to care deliverers in the quality improvement cycle.

Clinical quality measures have traditionally consisted of process or surrogate measures and centered on providers and hospitals. As we move toward a system based on value, the measurement system must shift as well. Part of this movement will be utilizing outcomes directly reported from patients and their caretakers and incorporating these outcomes into quality improvement initiatives and payment models. The widespread adoption of standardized and validated patient-reported outcomes measures (PROMs) would accelerate the development of a patient-centered health system. However, new standards; patient-friendly, digitally-enabled instruments; secure portals; and more research will be required to facilitate adoption.

Will Regina Holliday Become Health Care’s Rosa Parks?

The protest organized by Regina Holliday over a patient’s right to access their medical information is not quite the same magnitude as agitating for integration in 1950s-era Alabama. Yet there are intriguing similarities between the crusade Rosa Parks launched then and what Holliday is attempting today. Both involve a refusal to accept second-class status and a resolve to push back against entrenched institutions.

Parks’ story is well known. Her refusal to surrender her seat to a white male passenger on a Montgomery city bus in December, 1955, prompted her arrest and a sustained bus boycott by outraged black residents. That boycott’s success propelled a young Martin Luther King, Jr. to the forefront of the fight against segregation. Parks eventually came to be known as the “mother of the modern day civil rights movement.”

Friday Funny: Health care meets Jerry Springer – (in Pittsburgh!)

I know that secretly you’re all bored of this Supreme Court nonsense, and want to get back to the real business of health care, which is often the ongoing war between regional insurers and regional health systems. And the war in Pittsburgh between Highmark and UPMC has been as fierce as anywhere. But it’s been lacking in the kind of juice that makes for a good Friday afternoon scandal. Until now.

Last Sunday Highmark CEO Ken Melani got arrested. (This is a real arrest not one of the fake kind featured in last Friday’s funny). Melani’s mistress  was some 25 years younger than him and had been working for him at Highmark. That then progressed to her moving in with him. But after an argument with Melani last Sunday she went back to her husband’s place. Melani went around there and apparently accused her of only wanting him for his money –he was on about $4.5m a year–and ended up in a fist fight with her husband. Apparently his mistress wasn’t leaving him for good and wasn’t intending to get back with her husband, but one policeman apparently heard Melani say that he’d have killed both of them if the police hadn’t stopped him.  Either way it’s juicy stuff for health care.

Highmark  is in the process of buying  the only non-UPMC chain in Pittsburgh, West Penn Allegheny, and is still trying to get to a contract with UPMC that keeps it playing in the town–which UPMC of course dominates. Melani is now on unpaid leave and presumably not coming back any time soon, while as of today Highmark Chairman Robert Baum has taken the reins.

This may end up meaning nothing in the ongoing UPMC/Highmark battle, but I do sit here musing that the only way this would have been better for the Friday Funny is if the mistress in question had been UPMC’s CEO Jeffrey Romoff’s wife–who herself is some 30 years younger than Romoff and happens to be wife number 4. But as the Rolling Stones say, you can’t get everything you want!

The Strange Tale of NextGen and NextGen

There’s a conference styling itself as mini-TED for health care in New York next week. It’s called NextGen Health. There is of course a major EMR called NextGen Healthcare (owned by publicly traded QSII). You might imagine that there’s scope for some confusion between the two brand names, and you’d be right. But the tale of what’s transpired about that confusion is quite the melodrama. Read on and have your Friday chuckle.

Nextgen Health the conference is run by Ari Teman who also runs the Nextgen Charities conference. After he started planning the Nextgen Health conference, the other (bigger, richer, with the EMR) Nextgen asked him to stop using the same name and–when he refused–sued him for trademark infringement. Ho hum you say, happens every day. True, but then this gets more fun.

Saturday of last week, I got an email that was basically a press release saying that the CEO of QSI (the Nextgen EMR company) had been arrested that day for sending an emissary to conduct some kind of raid or home invasion on Ari Teman’s house. I paid attention partly because it was wacky news for the usually doudy EMR business and partly because I’d met Ari Teman at a function in NY the previous Monday. He’d invited himself to breakfast with me the next day where he told me lots about himself and how great his conference was going to be, and eventually asked for my & Health 2.0’s help in marketing it. You may suspect that meeting people who think their new thing is the greatest ever is not that unusual in my line of work, and you’d be right. So I took some of this with a grain of salt, but the line-up looked good and he had people I respect involved and so I agreed to look at a marketing deal.

Then the “press release” arrived about the “arrests” of QSI’s CEO, chief counsel, bottlewasher, dog and more, following the “raid” on Ari’s house while he was at the Aetna meeting at which I’d met him and I was speaking. The “release” was actually mostly a self-promotional piece for Ari and the conference (well, mostly about Ari who you may not realize is a “Jewish Federations of North America’s Jewish Community Hero of the Year“).

The first Sex::Tech hackathon

I’m on the board of ISIS, a wonderful organization led by the irrepressible  Deb Levine, that helps deal head on with issues of youth sexuality, mediated by technology. The annual conference is in three weeks, and there’s a hackathon the day before — Matthew Holt

ISIS is hosting our first ever hack-a-thon, together with our partners TechSoup. A hack-a-thon is a live event bringing together developers, designers, innovators and entrepreneurs to build exciting new apps and tools, in this case to improve young people’s health and wellness.

Theme: The Unmentionables

This short and focused event – 1 day only – will result in the rapid development of interesting concepts and working prototypes that will be developed further by the participating teams back at their desks and at future hack-a-thon events, with ISIS and TechSoup as partners for future product development and distribution.

Challenge: Design an app to solve the challenge of providing honest, real-time, private data from youth and young adults about “unmentionable” activities, like sexual behavior, substance use, sadness, and relationship drama to researchers and program experts who work with youth.

Health Datapalooza 2012: Throw Your Hat Into the Ring!

It’s a phenomenal time to be an innovator at the intersection of data and health care improvement.  I’m incredibly excited by the rising tide of innovations we’re seeing – new products, services and features being invented by entrepreneurs across the country, fueled by open health data.

And coming soon is the latest opportunity to showcase and learn about many of those innovations: the 2012 Health Data Initiative Forum– aka the Health Datapalooza — being held in DC at the Washington Convention Center on June 5-6, 2012.

For all of you who have been creating value from health and health care data – this is your opportunity to showcase your brilliance for the nation to see!  Led by the amazingly talented folks at Health 2.0, the Health Data Consortium is sponsoring a national competition for the best new apps and services created using health and health care-related data.  Entry applications for the competition are due March 30th.

Innovators will then go through an “American Idol”-style process in which panels of consumers, health care professionals, and community leaders will judge innovations submitted. The innovations that best demonstrate benefit and value for health and care improvement will be featured and demoed at the June Datapalooza.

So if you’ve built or are building something terrific with the aid of health data, throw your hat into the ring! Submit your entry form by March 30th, and may the best innovations win!

Help Shape the Future of Patient-Centered Outcomes Research

The Patient-Centered Outcomes Research Institute (PCORI) is an independent, non-profit organization created by Congress in 2010. Our mission is to fund research that will provide patients, their caregivers and clinicians with the evidence-based information needed to make better-informed health care decisions.

We’re committed to continuously seeking input from a broad range of stakeholders to guide our work. So as part of that effort, we’re asking for public comment on our first draft National Priorities for Research and initial Research Agenda, which provide a framework for and identify the broad questions that must be addressed so that patients can make better and more personalized decisions in partnership with their clinicians.

We released the draft priorities and agenda on January 23 for a public comment period that runs through 11:59 pm EST on March 15. You can read the draft priorities and agenda, answer 10 questions about them and provide general comments, here

We encourage you to provide comment through our website, but we’ll also accept input by mail. Responses received through pcori.org will be displayed for public view on the site.

After reviewing public comments and other feedback, PCORI will publish a report summarizing the input and explaining how it led to changes in the draft priorities and agenda. PCORI’s Board of Governors then must adopt the priorities and agenda before primary funding announcements can be issued.

PCORI is counting on you and your colleagues to you to help shape our national priorities and research agenda. Your feedback and perspective will help insure that our work is responsive to the needs of patients and those who care for them.

Eric Topol: Too Clever by Three-Quarters

Eric Topol was once a lowly (well not that lowly) cardiology professor at the University of Michigan, but he’s now without question the leading renaissance man in health care technology. Virtually every week sees him on some big stage disgnosing his own heart murmur with an iPhone app or showing off how his sleep brain waves and his genome interact or don’t.

His new book, The Creative Destruction of Medicine is a tour de force romp through basically every type of cool new medical technology. He covers the Cloud/Web/Wireless/Sensor phenomenon from both a social, transactional and diagnostic  point of view–leaning heavily on his connection to the West Wireless Health Institute which he helped persuade Gary & Mary West to fund. He’s the creator of a new medical school program at Scripps focusing on the genomics and proteomics revolution, and the book covers in great detail the evolution of the human genome project and its impact on disease discovery (coming eventually) and matching patients to the right drug (available more or less now). Finally he was of course the head of Cardiology at the Cleveland Clinic where he not only was heavily involved in the testing of tPA (the drug that built Genetech) but also in unveiling the problems with Vioxx not limited to the drug itself but also concerning Merck’s behavior at the time. (Remember Dodgeball?)
